The fact that Swiss event rentals does not prevail at a given moment in one or the other of these terms and conditions can not be interpreted as a waiver of any of the said conditions at a later date.
Anyone placing an order on the site www.swisseventrentals.com declares to be 18 years old or over and is in possession of the legal capacity or in the absence of a parental authorization allowing him to contract the order.
In the event that these conditions have not been respected in accordance with what is stated in this contract and in order to resolve a possible dispute, the company Swiss event rentals reserves the right to apply directly to the guardian or legal guardian of this person and therefore authorizes to demand from him the payment of all possible orders made.

In the event that these conditions have not been respected, in accordance with the clauses provided for in this contract and in order to resolve any dispute, Swiss event rentals reserves the right to contact the person who has taken out this order directly and to contact to require of her the regulation in her personal capacity, that she was entitled to contract on behalf of her company or that which then employed her.
For services: Prices are exclusive of VAT, excluding transport and insurance, excluding setting up, assembly and disassembly, for the duration of use provided during the order, according to our current rates.
Any use over this period will be subject to special agreements and additional billing. The date and the time of return of the material are imperative and any delay will be invoiced according to our tariffs in force.

All orders must be placed through the website, unless special agreements to the contrary and subject to the availability of equipment at the time of receipt of the order.
The benefit of the order is personal to the client-client and can not be assigned without the agreement of Swiss event rentals.
Deliveries are available on all orders over 200 CHF. Swiss event rentals reserves the right to refuse an order.
The equipment is taken care of by the lessee at our depots according to our opening hours:
Monday - Friday from 08:30 to 17:30
The withdrawal or the return of the material is not possible on the holidays or days of holidays of the company.
If the rented equipment could not be made available to the lessee for reasons beyond the control of Swiss event rentals, the contract will be modified or canceled without any compensation can be claimed by the lessee.
The minimum rental period is 24 hours.
Rental days start at the hardware pick-up time and end 24 hours later.
All days started are considered to be due in full. The date of return is imperative. Any delay will result in billing on the basis of the daily rate from the time of removal. The days of delays will be charged at the normal price with surcharges according to the scale below:

Unless expressly agreed in writing by the lessor, the return of the equipment must always be done at one time.
The total or partial cancellation of an order will be subject to a billing equivalent to at least half of the amount of the order, without ever being lower than the costs already incurred at the time of cancellation.
If the cancellation occurs less than 72 hours before the rental, sale or service, the canceled part will be due by the client and charged in its entirety.
The postponement of an event will be accounted as a cancellation, hence subject to our cancellation policies as follows;

The rate applied for delivery and resumption depends on the scale in effect. The scale is calculated according to the canton where the goods are delivered. Transportation includes unloading at the indicated address (delivered on the sidewalk and not included).
Any last minute change of destination, handling not foreseen in the initial quote and waiting times will be subject to an additional billing.
The installation of furniture or technical equipment will be the subject of an option offered when placing an order on the website. A personalized quote will be drawn up according to the quantity and furniture / equipment chosen and a separate invoice will be sent to the client.
For any order, a deposit of 20% minimum (adjustable depending on the equipment / furniture rented) of the total amount is requested from the customer, which will be returned to him after checking on the return of the equipment and after receipt of the invoices, unless special agreements to the contrary .
In the event of a problem with the equipment upon return, the deposit may be withheld partially or entirely to cover the costs. The deposit must be paid in cash on the day of delivery of the furniture / equipment. In return, a document will be signed by Swiss event rentals and the customer certifying the delivery of the deposit.
The ordering customer must be present during the delivery and return of the rented equipment. He acknowledges receiving equipment in good condition, fit for operation and in good standing with current health and safety standards. A delivery note will be signed by the receiver attesting the good reception of the equipment / furniture in good condition.
The ordering customer undertakes to return the equipment rented, sorted by category, and packaged in their protections, bins and trolleys of origin.
An inventory will be made at the disposal and return of the rented equipment. The ordering customer is required to attend in order to sign this inventory.
In the absence of a signature or refusal from the client, no dispute will be admitted and only the inventory of Swiss event rentals will be deemed valid for the taking and return of the furniture / equipment.
The material must be made clean. The costs of cleaning are the responsibility of the customer, except tablecloths, covers and towels. In case of cleaning by us, charges may be added.
Any costs incurred in the event of damaged, defective or dirty equipment will be charged to the customer, unless proof of liability of Swiss event rentals.
The total amount of the rental may be subject to surcharges in case of last minute extra orders.
The ordering customer undertakes to use the rented equipment in accordance with its usual purpose and to do nothing or allow it to deteriorate. In particular, it will provide the electrical installation with the necessary power in accordance with the regulations in force.
The ordering customer certifies to be able to use the rented equipment, himself or through duly qualified authorized persons. No modification or transformation may be made to the rented equipment. The ordering customer is responsible for the fact that the rented equipment is not used for activities that are contrary to the law and the rules in force.
During the entire period of availability, the client is responsible for the maintenance of the rented equipment and to protect it against any degradation, vandalism, overload, bad weather, rain, wind, snow, frost etc. The ordering customer is not entitled to any compensation in case of interruption of operation of the rented equipment.
In case of non - functioning of the rented object, the tenant is forbidden to carry out himself the repair of the material. Only the renter will carry out the repair. No compensation or damages can be claimed by the tenant because of the immobilization during the time of the repair.
Damaged or unreturned equipment will be billed to the ordering customer at its replacement value of nine, plus an allowance to cover the unavailability of equipment.
Throughout the term of the lease, the Lessee agrees not to assign, pledge, sublease, alienate the rented equipment.
For individuals: Any order will be paid exclusively on the website by bank transfer. Unless otherwise agreed, payments will be made in CHF.

In case of deferred payment or term, a maximum period of 30 days is granted after receipt of the invoice corresponding to the order. A deposit of 50% of the rental price at least must be paid before the rented equipment is taken into account.
In the event of late payment, Swiss event rentals may suspend all outstanding services without prejudice to any other course of action.
Any amount not paid by the due date shown on the invoice entails the application of late payment penalties set in the special conditions.
Swiss event rentals reserves the right to offset current invoices with the sums in its possession, of whatever nature, paid by the client.
Unless otherwise agreed otherwise, Swiss event rentals shall not grant any discount in case of advance payment.
Swiss event rentals reserves the right, at any time, depending on the risks involved, to set a cap on each customer's overdraft and to require certain payment terms or certain guarantees.
This will be particularly the case if a change in the client's capacity, in his professional activity, or if an assignment, lease or pledging or contribution of his business has an adverse effect on the credit of the client.
In addition, in the event of non-payment by the client before the service or rental is provided, Swiss event rentals reserves the right not to provide the requested service or rental in whole or in part.
Invoicing is done at the order of the client and the beneficiary can not be changed without the prior consent of the service provider.
Each non-scheduled rental day for the return of the equipment will be billed to the client as the day of the event.
Any additional services not included in the offer will be added according to the prices charged by Swiss event rentals.
On-site work time for assembly and disassembly will be billed according to actual hours. Any waiting or delay will also be billed as working hours.
The material sold remains the sole property of the Swiss event rentals until full payment of the price, principal and interest, and is opposable to the mass of creditors in the event of insolvency proceedings.
However, the transfer of risks takes place upon delivery.
The present general conditions of transaction can not involve any transfer of intellectual property rights that can be implemented under the ordered service. The software and documentation equipment and any technical or other information belonging to the service provider are and will remain the exclusive property of Swiss event rentals.
Subject to prior agreement, the customer authorizes Swiss event rentals to quote it in its commercial documents in any form as commercial reference.
Each party will guarantee to the other the confidentiality of information of any nature whatsoever, written or oral, which it knows about the order and refrains from communicating it to the persons other than those who have quality to know the content for the realization of the ordered service.
Swiss event rentals can not be held responsible for delays or delivery failures due to force majeure or any reason beyond its control, such as, without limitation, strike, bad weather, accident, official prohibition etc.
Liability and material and legal custody of the equipment are transferred when they are made available. The ordering customer assumes this custody under his full and sole responsibility.
He will take out an insurance policy at his own expense to guarantee his responsibility during the time he has custody of the facilities and equipment.
The ordering customer, as organizer of the event during which Swiss event rentals operates, must take care in particular of obtaining all the authorizations necessary for the services ordered, to ensure that the places are available. and easily accessible of any kind, and obtain from its insurers the possible extensions of guarantees.
The customer undertakes to guarantee Swiss event rentals against any recourse and / or claim of any nature whatsoever that may be exercised by its staff or by any third party, in connection with the service, due in particular to any damage to property or to persons, attributable to the client or to any other person acting on his behalf or to things in his custody. He undertakes to indemnify Swiss event rentals for all damages, losses or expenses resulting from such recourse and / or claim.
No complaint from the client giving the order will be admissible beyond a delay of 48 hours after the end of the service.
No compensation can be claimed from Swiss event rentals for deprivation of enjoyment or commercial disturbance whatsoever, whatever the cause or origin.
In the event of a dispute, the Seat Tribunal of Swiss event rentals shall have sole jurisdiction.
This clause applies even in the event of summary proceedings, incidental claims or multiple defendants or warranty claims.
Swiss event rentals reserves the right to modify these conditions at any time without notice. Any dispute arising from this contract will be subject to the exclusive jurisdiction of the competent courts of the canton of Vaud.
Failure to pay the invoice (s) by the due date will result in the due date:
- late penalties calculated on the basis of the interest rate applied by the Swiss National Bank to its refinancing operation plus 10 points, on all outstanding sums;
- legal and litigation costs;
- a penalty clause equal to 15% of the sums due.
- lump sum compensation for recovery costs of CHF 50.
